TERMS AND CONDITIONS OF SERVICE
Our service is aimed squarely at the smaller businesses and we strive to provide quality.
To assist this, certain hosting requirements are not suitable for our service. Below is a list
of requirements you may have that we will not host but will recommend alternative solutions for.
- Adult content
- We will not host any content of an adult nature. If you have content that is adult orientated but not pornographic then contact us to discuss the details.
- Illegal content
- Self explanatory really. Anything that's in breach of the law in the UK is strictly forbidden. We regularly monitor content on the servers for anything in breach of the terms of trade and if found, we reserve the right to terminate the contract immediately.
- Copyright material
- You must be authorised to publish copyright works. If in breach, your account will be terminated.
- Downloads
- To maintain quality for all clients, please keep any individual file to less than 1Mb in size. If you have large files to share, there are many other tools and services to allow this.
- Streaming video or audio
- This can place huge demands on the servers and bandwidth used so therefore we recommend hosting your website with us but the streamed content elsewhere. Video content is best streamed from YouTube or Google Video if the video is very large. Oh, they're free too.
- Bots, relays
- We do not allow bots and/or relays on our service. This can place huge demands on the hardware as it has to do a lot of processing. If you require such facilities perhaps look at dedicated servers.
- Gaming servers
- No gaming servers allowed. Again, big demands placed on the hardware can be detrimental to other users.
- No executables
- No files that run as executables are allowed such as .exe, .pif, .bat etc. These files if hosted will need to be kept in a compressed folder such as a zip file.
- Bulk mail
- Mailing lists for your business are fine but mass emailing is prohibited. This is carefully monitored and any client seen sending mass emails will need to justify this or face account termination.
- Indeminity
- You shall indemnify us and keep us indemnified and hold us harmless from and against any breach by you of these terms of business and any claim brought against us by a third party resulting from the provision of Services by us to you and your use of the Services and the Server including, without limitation, all claims, actions, proceedings, losses, liabilities, damages, costs, expenses (including reasonable legal costs and expenses), howsoever suffered or incurred by us in consequences of your breach or non-observance of this Agreement.
- Limitation of liability
- All conditions, terms, representations and warranties relating to the Services supplied under this Agreement, whether imposed by statute or operation of law or otherwise, that are not expressly stated in these terms and conditions including, without limitation, the implied warranty of satisfactory quality and fitness for a particular purpose are hereby excluded, subject always to subclause. Nothing in these terms and conditions shall exclude our liability for death or personal injury resulting from our negligence. Our total aggregate liability to you for any claim in contract, tort, negligence or otherwise arising out of or in connection with the provision of the Services shall be limited to the charges paid by you in respect of the Services which are the subject of any such claim. In any event no claim shall be brought unless you have notified us of the claim within one year of it arising. In no event shall we be liable to you for any loss of business, contracts, profits or anticipated savings or for any other indirect or consequential or economic loss whatsoever.
